What is CRPC 340--when one can use it ?

Mine opponent has filed some false evidence in the court ,my advocate says that we can exercise crpc 340,is he right?

What benefit we will get ?

If the false statements are lied on oath then such petition can be filed for making the inquiry by the CJM in that respect and to issue process.

Yes. You can file proceedings under Sec.340 Cr.P.C.

False and allegation of being false are two defferent things in law.

If in any procedding any submission when even taken on face value is on the face of it is false than only s 340 will be attracted.

Just because it is false in your opinion has no meaning , you have to prove it to be false than only section 340 will be attracted.
