What are the legal steps can be taken against tenant India

Tenant do not give money on time .we have already given 1 month time to vacent the home. No rent agreement. Tentant living since 6 months. what are the legal steps can be taken if they do not vacent the home after 30 days.please help

For legal action against a tenant, some legal document, like agreement is also a must, which you do not have. When you have not fixed any date for payment of rent through any agreement, you may have to compromise with the mutually settled date for payment of rent. Simply serving legal notice without the valid reason for vacation of house would also not justify any legal action.

Even now, it would be better for you if you insist the tenant to enter in to some agreement by presenting that to be signed by him in the presence of two witnesses. If he refuses to sign, only then you will have a cause for eviction of the tenant by sending notice and to file a case in the court of law for his eviction.
