UPON hearing counsel the Court made the following
ORDER


I.A. No. 226 of 2008:

This is an I.A. filed by the Government of National Capital

Territory of Delhi, for clarification of order dated 22.1.2008

passed by this Court, in regard to the implementation of

recommendations of the Shetty Commission so far as it relates to

staff members working in the subordinate courts.

The report of the Shetty Commission, as regards the

Judges of the subordinate courts, was filed in the year 1999 and it

was made effective from 1.7.1996. The Shetty Commission also

made its recommendations with regard to the members of the

subordinate court staff in March, 2003. So far as the date of

implementation of the recommendations of the Shetty Commission

with regard to members of the subordinate court staff, we make it

clear that it shall be made effective from 1.4.2003.

I.A. No. 226 stands disposed of accordingly.



I.A. No. 71A, 135-136, 137-138 & 142:

Pursuant to our directions given earlier, a composite

compliance chart was prepared in regard to the implementation of

various recommendations made by the Shetty Commission. As

regards the perquisites, allowances etc. payable to the staff

members of the subordinate courts, 19 recommendations were

classified separately and each of the States was directed to file

separate affidavit regarding implementation of the

recommendations of the Shetty Commission. Many State

Governments have not filed proper affidavits in this regard. States

like Sikkim, Punjab, Haryana and Union Territory of Chandigarh

have complied with the recommendations of the Shetty

Commission. As regards other states and Union Territories, it is

submitted that the discussion is going on between the High Courts

and the State Governments.

We must say that the report was submitted on 31.3.2003 and we

have been giving repeated directions to implement the

recommendations but most of the States have not complied with.

The general objection of the State Governments is that there is

difficulty in implementing these recommendations because the

State Governments are short of funds. We do not think that by

implementing the aforesaid recommendations, the State

Governments will have to incur heavy financial burden since only

reasonable recommendations have been made in the report and the

States and Union Territories can look into these recommendations

and take proper decision at the earliest, at least within a period of

three months from today. We direct the States and Union

Territories to file affidavits indicating the latest status on or before

20.10.2008. Before that the Registrar Generals of the concerned

High Courts shall hold discussions with the State Governments and

Union Territories in regard to the implementation of the

recommendations of the Shetty Commission and take a final

decision in the matter. It is made clear that no further time shall

be granted to implement the recommendations of the Shetty

Commission.

We have already passed an order in I.A. No. 226 finalising

a date from which the recommendations of the Shetty Commission

with regard to the staff members of the subordinate courts are to

be made effective. Copy of this order shall be sent to the Registrars

of each High Court so that they may take timely steps.
