Vehicles confiscated by police

Guest (Querist) 13 October 2010 This query is : Resolved
Dear Sir
I find it strange new vehicles accidented or otherwise involved in some disputes lying in the open for years in the police stations across the length and breadth of this most unfortunate country with a corrupt to the core judiciary, bureaucracy as well as policesystem.
What the ' Your Lordsheeps ' can do to dispose of this vehicles in disuse ( or abused by the police only )? What are the rules which can be kick started ? And how the vehicles in the police stations accounted for ? If yes , who is responsible to cross-check as your lordsheeps are not expected to get out of their ivory towers to do such dirty jobs?
Regards
Haridas Mandal

These vehicles are MO- "Material Objects" marked or to be marked related to many criminal cases. Once trail is over court asks the concerned Police Dept to hand it over to the owners. Since many vehicles are theft vehicles there won’t be no takers also. Auctions are being done by the dept to sell these vehicles.
To speed up trial, like in Singapore, Govt should consider to amend the Criminal Procedure Code. Accused has to prove his innocence instead of prosecution proving the case beyond doubt. When burden of proving shift on the accused, he has to attend the criminal cases regularly and trial will be completed in short span of time.

Dear Sir
When a case on an average takes 22.5 years to complete where is question of holding those so called material evidences in the police museums.
I don't think any of the judges post independence from our colonial masters ever got out of his/her Ivory tower and inspected personally those so called material evidences. Then what for those show pieces be kept in those police museums - Ramjethmanalies, Arun Jaitleys, Abhisek Sighvies to see and get inspirations. The advocates in India are quite capable of manufacturing witnesses by the dozens , eye witnesses by the thousands . The ' yourlordsheeps' will see the material evidences through the ' eyes of Ram,Arun & Abhisekhs and sometimes through Anands. Where is rocksolid case for preserving those showpieces in the police museums for brutal misuse. Why it can not be auctioned by Chisties of England or PWC Satyam infanous.
It is high times advocates in India stop talking about maintaining statusquo which most of their tribes violate very often. And i may not be the lone voice to say those vehicles at the polive stations are grossly misused by the police and even loaned to brother judges for their private use. It is a vicious cycle and need be stopped forthwith by ' Your Lordsheeps ' please.

Dear All
If you all agree that the present procedures is antiquated and counterproductive why not raise the point for immediate discussion by the Parliament during winter session itself.
Can somebody guide me how to submit the point for tabling at the Loksabha ? I am completely free from preoccupation post retirement.

I am astonished with the suggestion from the learned members.

Sir please think over the issue again and our citizen's moral also.

According to this phenomenon.

If I would be a police officer I will caught your with your watch, shirt, pant, tv or other article and you may be accused of 380, 411 and surely shall be punished if you don't have the cash memo.

Dear All
Before it takes an absurd form may i request some practising lawyers or retired police officials to quote /unquote the law of the land in black and white to deal with the MO held for years in the police stations and being put to great misuse.
Will some retired Judges of the Lower/High/SC comments on the subject advising us how to tackle this menace.
I have A couple of observations on the functioning of our civil courts (I was insulated being in the Army for 31 years).

First- One fourth of our citizens are engaged in attending the courts for most silly to most funny reasons. YourLordsheeps , like to live in their respective Ivory towers and are most insentive to this Issue.

Second- Undertrials at the Jails for the funniest reasons and due to inefficiency of Yourlordsheeps are the constant source of income for the Jail contractors, the jailors , the police , the IAS.com and for some Your lordsheeps.

Third- Vehicles confisticated due to funny to serious reasons are allowed to be kept in the Police Museums sorry Stations are due to most inefficient yourlordsheeps. The legislatures are clueless about this principle root of police corruption.

Can we approach Mr Moilly to draft an ammendment to the present law on MO?

Haridas

I would like to request the administrator of this site keep this thread open as the issue is of national importance. It is not the LOKPAL Bill( A feudal Lord if it is JANLOKPAL BILL) which will drastically reduce the corrupt practises but a few good effective laws of this nature and the whole hearted involvement of our LORDSHEEPS.
I seek your help to draft a effective bill for this purpose.
