Trademark registration

(Querist) 22 April 2010 This query is : Resolved 
Sir,

We moved an application for registration of Trademark on 14.08.2007 before the Authority.
that on 16.04.2010 a show cause notice issued by the authority by which they asked for and to get the registration of same on showing evidences because the status of application is showing OBJECTED.
My query is that what is the limitation period to move any objection after advertisement of application for trademark registration?

Once you have filed trademark application it must be notified in journal after examination and acceptance by the registry. Once it is published in the journal any person may oppose the same and has to file a Notice of Opposition (TM Form 5)within 3 months with a further extendable period of 1 month i.,e (totally 4 months). You may check the date of publication of your mark in the journal and check whether the objection (opposition) has been filed within 3+1 (4 month) period.
