Whether non registration of an assignment deed of a trademark in the Office of Trademark Registry, will render assignment deed as null and void and can a assignor claim back its trademark on that pretext?

Yes. It shall be treated as null and void and assignor can claim back its trademark on this ground.

Application fo registeration of Assignment is madein FORM No 24 or FORM No 23 whereas assign makes application alone then it is made in form no 24. If the apllication is made by the the assignor as well as the assignee then it is made in form no 23.Rs 2,500 for eac mark is required to paid with the application.Or if the assignor has also other marks proposed to be assigned to the assignee then Rs 500 for every additioal mark as fees to be paid with the application.
