can A trademartk of a company be used by a sister concern ?if yes ,will the company have to pay for it or not, or it depends on the terms & conditions between the two.

no asper the IPR act .Because legal and treade mark been allocated only for one company and if any one use then it is against the trade mark .

Dear User,

If the main company has registered the trademark, definitely it can license or assign the trademark to its sister company or any company for good faith.

As long as the line of business is same it holds good...

I will give you a scenario... TATA is in to multiple business lines

Main Company: TATA Motors line of business is Automobiles.

Sister Company: TCS line of business is Software

Eventhough TATA assigns the trademark, the line of business TATA has registered is different from the line of business of sister company.

It should be assigned through a registered agreement.
