Token money

I am given Rs.10,000/- as token for flat purchase in miraroad to owner, he is sole owner of flat, There is no any document or agreement singed by us it is mutually agreed that I will pay Rs.190,000/- and at that time we will make a agreement for sale as received 200,000/- as token money, I paid him Rs.10,000/- in cross cheque in his name, now I came to know that building construction is done without any local authority approval now when I demanded to give back my token money i.e Rs.10,000/- he saying I will return this amount in cash but you have to pay around Rs.9000/- to my agent. I am not agreeing for this and when I demanded to pay this amount in cross cheque to my name he is saying that now I will not going to return your amount, in this situation what I have to do.

You have no proof to show that the money was paid as earnest money towards a property.
You are really in a tricky situation.
Try to negotiate with him as whatever you get would be a bonus as the money is otherwise lost.

issue legal notice if you so desire but as pointed out by experts you have no evidence money was paid as earnest money
