Time limit for starting disciplinary proceeding

(Querist) 20 April 2016 This query is : Resolved
An employee of a private limited company has resigned from service in end of Jan'16. Till date the employee has not given release by the company nor his final dues settled. Now the company intimates that they intend to start disciplinary proceedings against him. Is there any time limit within which such disciplinary proceedings has to be started in case of private limited company? Is there any case laws which can be cited in this matter.
RAJU O.F., (Expert) 21 April 2016
The employee is not relieved from the company. Company would have initiated preliminary enquiries, after his absence and finding issues for disciplinary proceedings might have proceeded for that now.

It seems Company want to pressurize, you should send notice asking relieving letter and final dues as you have resigned.

It may not be that simple. We don't know the terms of contract and the provisions agreed by the employee for quitting the company. Any how consult and expert lawyer handling labour law matters.
