Tenant eviction order

(Querist) 05 February 2024 This query is : Resolved
Namaste sir,

We rented one house in Tirupathi without entering into rental agreement. The tenant is paying rent regularly but creates nuisance whenever our childrens plays in our compound.
Moreover tenants being senior citizens with two grand childrens as their daughter and son in law stays abroad.
So we have asked him to vacate as they are in a process of purchasing a flat nearby our house.
Initially tenant agreed to vacate the house before this month 6th. But today the tenant is adament in not vacating our house with harsh usage or words against us.

Now can we file eviction order from the court, If so how long it takes to obtain eviction order from the court against the nuisance tenant.

Please advise

You can file an eviction suit but it cannot be said how long the case will go.
T. Kalaiselvan, Advocate (Expert) 07 February 2024
You can file an eviction suit to evict the tenant if the rental agreement has expired and you do not ant to renew the same or if you require the premises for your own use.
The time taken for disposal of the suit cannot be predicted owing to various factors involved in it.

Thank you sir for reply

But time limit is most essential and important in getting justice, but why our system so slow
kavksatyanarayana (Expert) 08 February 2024
Our system is not slow. There are cases in large number and the parties after filing petition, mostly absent on hearing days.
Hari Konanur (Querist) 08 February 2024
Ok sir

But request to fix time limit in getting right justice at right time for all

Delayed justice is denied justice as we all know
Hari Konanur (Querist) 08 February 2024
On hearing day atleast from video call the petitioner or defender can be connected to court to put delay in justice
T. Kalaiselvan, Advocate (Expert) 09 February 2024
You cannot break the law for your convenience, we have to go by the law because law is common to all.
The court cannot decide the case in a single day without hearing the parties following the procedures of law.

Ok sir thank you for replying

So eviction order getting 3 to 5 years is really painful for owner's

Many good peoples are only getting victimized as we notice

With humble request from our side request all our honourable lawyer's to speed up in disposing the cases after meeting right justice

Because common man has only one and last hopes on judicial system in India
