It will depend upon as to under which Section you deducted or ought to have deducted the TDS.
Raj Kumar Makkad (Expert) 12 January 2012
Section 203 of Income Tax Act, 1961.
R.Ramachandran (Expert) 12 January 2012
Dear Mr. Makkad,
The querist wants to know which Section he has to quote - whether 94C, 94I or 94J - in the Challan while remitting the TDS.
Devajyoti Barman (Expert) 12 January 2012
Yes but what is the reply?
I have no expertise in Taxation matters.
Raj Kumar Makkad (Expert) 12 January 2012
If one has no expertise then it is no use to mark personal presence even for tax queries.
Raj Kumar Makkad (Expert) 13 January 2012
The perfect section shall be 94I
R.Ramachandran (Expert) 13 January 2012
Dear Mr. Makkad,
I wonder on what basis you say Sec. 94I is perfect in this case, when the querist has not revealed any facts at all to come to that conclusion.
Sailesh Kumar Shah (Expert) 13 January 2012
I feel that It would be income tax assessment order.

ITO, issue demand notice, when department is unable to reconcile.

Make representation before ito with tds certificates copy, which was issued in your favour and advance tax with challan copy.
THARMALINGAM NADAR (Querist) 13 January 2012
Dear All,
thanks for the reply

I think you should meet the relevant assessing officer along with the order. he will clarify you under what section you failed to deposit the tax.
