Summon's to Witness

(Querist) 10 January 2011 This query is : Resolved 
I am plaintiff and want to examine expert In Civil Suit for proving my plaint. then under what Section and Order and Rule summons to expert witness can be drawn? for 1) Bring the documents with his custody.
2) and for compel him to give evidence.

Is there any need of separate application to retain the document brought by witness in court custody? if yes under what section and Order and rule

you need to file list of witnesses first and then can summon him . Read order XVI CPC , you can also summmon the original documents as well. The copy of documents would be retained in Court and the original will be verified there and then only.

Plaint cannot be proved by an expert. If there is signature and anything you want to prove about the documents then you will have to call an expert that too after giving the expert opinion.
Plaint is yours you have to prove the averments of the plaint.

There is no separate provision for experts in C.P.C. The evidence act sec 45 has stating the same. But in civil suit you can file the list of witnesses to who,m you want to examined in support of plaint( witnesses, experts, scribes etc) under order 16 of C.P.C

If you want a expert opinion on any document, you have to send it to the forensic lab. After receiving the report, you can call him as a witness to prove your case.

the plaint has not been proved by the expert. It is your duty to prove.
But if any of document would be proved by an expert, you pay bata send summon through court under order XVI Rule 2sub clause(2). You did not compel any of person for witness.
