Dear sir,
my back side house owner construct a house in back side of my house. But he did not took licence from muncipality and he did not follow setback rule of muncipality and stick pillar rod to attach to my building and i immediately go to court and apply for injuction order and court also issued injuction order for stop work to construct a building. Now please suggest me what is my next process. And please tell me is there is chance to vacat injuction order by defendent and construct house without follow setback rule. Some body told there is a chance to defendent to apply caveat and run construction work without follow setback rule. I am in huge tension please suggest me. Waiting for your reply

There is least chance of the vacation of injunction order if the same is going on without permission of municipality and flouting the construction rules causing damages to your house.

court must have passed injunction order after hearing both parties .

as pointed out by prabhakar sinhji permission of muncipal corporation is must for carrying out construction plans . the plans must be approved by ciorporation .

thanks for suggestion. but back side house owner did not take licence from muncipalitity. 15 days back officer and engineer of muncipalility came to spot and told that owner of backside house did not take permission from munciipality. so now please clarify me is there is any chances to defendent vacate injuction order without having licence. some people told that there is chances to defendent to apply caveat and vacate injuction order and construct house, is this true
