Sudden change in eligibility criteria

(Querist) 05 October 2015 This query is : Resolved
The RBI has suddenly changed their eligibility criteria for officer examination from this year. They did notify in Aug itself but one has to study well in advance to cover the huge syllabus. Request to reconsider has fallen on deaf ears. Can they be legally forced to postpone new rules?

Try your luck, if you can succeed to change the requirement of the RBI just to accommodate yourself.

Any employer is bound to see its own requirements fulfilled, not for the fulfillment of the requirements or wishes of the prospective candidates.

Success is doubtful if RBI has refused to reconsider.

You have posted that:.......'They did notify in Aug itself'............

So apparently RBI has notified in advance.

Do your proper homework and assess would it really be worth to agitate!

They notified in August. But exam is in Novemberm and it takes time to study. So thats not a notification at all! Ad it is not to accomodate myself it is for several candidates. How to proceed if I want to?

If you feel like suing the RBI, you need not proceed , except to contact some local lawyer to to take up your case for filing in the court of law as per the set procedure.

It shall certainly be better to consult an able counsel before proceeding on your own.

Thank you to all. I am going to file a petition. Will talk to a lawyer. I read there is something called doctrine of legitimate expectation in common law. May be useful argument.

Expert Mr. Dhingra has observed and remarked properly. In fact you also have your own observation, so you can guide your counsel to be engaged on that point for proceeding with this issue.

I consulted two lawyers. One is demanding 40,000 for fees other says it is difficult to succeed since they had given pre notice. But rbi gave pre notice as recently as 19 aug. And applucation date started from 5 oct. I still know I have a chance. What to do now?

Correction...other lawyer says it is difficult....

1. If you pay Rs. 40000/- to the lawyer - and your case succeeds - You get what you desired - and you will feel spending Rs. 40000/- is worth.

2. If you pay Rs. 40000/- to the lawyer - and you loose the case - You do not get what you desired, but also loose Rs. 40000/-

3. You simply keep quiet. You do not get what you desired, but you also do not loose Rs. 40000/-

The above are the only possibilities. Therefore you decide yourself - which option you like.

One thing is quite clear to me - the lawyer who demanded Rs. 40000/- is a smart guy and knows how to make money!
