Querist : Anonymous (Querist) 29 January 2011 This query is : Resolved 
whether an unregistered agreement to sell which tansfer the property to transfree in actual physical possession, the agreement to sell can be tendered in judicial proceedings, whereas the Registration Act provides under section 17 compulsorily registration. The opinion be expresssed with respect to that the same can be impounded under section 33 of the Stamp Act.

If the possession is given thru., un regd., of agreement of sale it cannot be admitted as an evidence in the suit. To get it admitted stamp duty and penalty will have to be paid.
It can also be impounded.
