Is legal notice to defendant mandatory before filing suit for sp. performance of contract
Before initiating a lawsuit for specific performance of a contract, it is a legal requirement to first issue a formal notice to the defendant. This notice serves to ascertain their willingness to fulfil their contractual obligations. You can only file a suit if the defendant demonstrably refuses to comply with the terms outlined in the contract.
