sons want share in the property given to daughter by the father

(Querist) 19 June 2008 This query is : Resolved
When can son asks for the partition of property? wht if father has self acquired property only? what is the status of married daughter in that case?

If the father is willing to give then no problem. No right accrues to daughter or son as a right. If he dies without a will then the property will pass on to both sons and daughters equally.

well father can gave his self acquired property to any one , u dont have any remedy for that apart from wining the favour of ur father and the situation cannot get changed by asking same thing in different manner, everyone has a right to dispose his or her property self acquired in the manner he or she wants and no one can force not even their own children. if one want then he or she can give that property to unknown also without giving single penny out of it to their childrens.
but this all in the self acquired property in case of ansestral property the situatiion is different if that property is acquired by parents by virtue of succession but here also there is twist if the ansestral property is coming to ur parents by virtue of will then it would be treated as self acquired property and they are entitled to dispose the way they want to.

With regard to self acquired property a father can dispose the property as per his wish.
