Sgbm waiving off penalty

Sir,
I just want to know if the SGBM has got the power/authority to waive off a members dues to the society. If this penalty is more than Rs.20,000/- and the person has been penalised for encroaching the property of the society. Can I take up this matter in court

SGBM should not waive penalty imposed against such erring person but unfortunately in the name of democracy all devils are being worshiped.
