Whether the session court can modify the technical Error caused by the committal court. If yes, whether that effect, the case may re-open for the fresh consideration. Also related citations please .

Technical error can be corrected at any stage and this doen't mean the re-opening of the case and neither of the parties are allowed to take undue benefit out of this correction and it is presumed that the error was not existing at the very outset and accordingly the trial is commenced.

no if did not give any right for frest consideration, as the technical error can be modified by court before the delivery of judgement , it does not give anything to the case to be tried as a fresh trial of the case, because it is the procedural defect which cuase due to court technically and does not create any effet in the facts and circumstances of the case
