Service & vat tax

Sir,
I have purchased flat in New Mumbai before 2012.My agreement had done before 2012.Now service tax is 2.575% before 2012 and 3.09 after 2012. Till date I have not paid the sevice tax. Builder is asking me to pay the service tax at the rate of 3.09%.So please confirm me that whether I should pay service tax at rate of 2.757 Or 3.09.My flat agreement value is 21 Lacs.
