Self-acquired property

sir,
my father has purchased a shop in the year 2001.the shop is my fathers self-acquired property. my father has given the permission to my uncle to sit in that shop,as my uncle has no other means of income,my uncle has to pay rs.5,000 every month to my father.there is no written document in this regard and all this thing were done orally. but after 2-3 yrs mu uncle refuse to leave the shop and also rejected to give the amount of 5,000 to my father.the shop was purchased by my father in my younger brother name,my uncle has also forged the documents and has added his name instead of my brothers name.
1. what remedy is available in law if we want to file a case against my uncle
2.is there any bar of limitation if we file a case
please advice...

if property has been purchased in name of your younger borther name he has to file suit aginst his uncle for eviction . issue him legal notice . if uncle has forged documents first file criminal complaint of forgery aginst uncle
