Querist : Anonymous (Querist) 12 May 2010 This query is : Resolved
Dear Sirs,

Please tell as to how a case of dowry harassment proved? Usually documentary proof is not available. Are only the statements of witnesses sufficient? That too only that of the wife and her relatives? Or some independent witnesses also needed? Under which section and statute the case booked? Thanks.
Arvind Singh Chauhan (Expert) 12 May 2010
Documentary proof is not necessary. Oral is enough. Independent witnesses are not necessary but are of more value. They can be booked under 4/5 DP Act. They may be prosecuted under DV Act and 498 IPC also.

I do agree with accurate reply of arvind.

In cases regarding Matrimonial offences, oral evidence is much valued than documentary
