Sec 340 Cr PC

(Querist) 29 July 2010 This query is : Resolved 
IN PFA case complianant/witness has submitted forged documents during cross examination. I have filed application u/s 340. Reply is received and matter is fixed for arguments. Can an expert help me by refering a good citation to make my case strong

Citations do not fit for every situation.Every case has deffrent facts and circumstances.

However if study deep , this is most potent weapon to blunt the opponent.

No doubt citations do not fit for every situation.Every case has different facts and circumstances, but in this case the complainant/witness has fabricated documents and submitted that they are dowloaded from website. Can you suggest any common citation which helps the case in bounding the court to take action on this application u/s 340

Refer : Iqbal Singh Marwah and another Vs. Meenakshi Marwah and another
(AIR 2005 SC 2119)

This re. also removes the bar of S. 195 and is based on 'forgery' to be specific.

There are other citations which will help in establishing the asked que. in your post and like ld. members advised correctly you need to understand the effects and infrence drawing before Court and seeking remedy and also support your arguments with relience of several Case Laws to get relief in asked situation.
