School next to our apartment

(Querist) 24 August 2015 This query is : Resolved
Hello Sir, Madam

A bangalore based reputed educational institute running colleges and school is planning to construct a school next to my apartment(30flats) in bangalore. my apartment is situated in a 30 ft road. School authorities have not been able to get access to land directly from the main road as the land ownder of the land adjacent to main road is not willing to sell the land. already there is another international school and a high rise apartment(600 flats) is using our 30 ft road. following are my questions

1) is a private school considered as commercial establishment like hotel, shops etc
2) Is there any rule which stipulates on access to a school where hundreds of children and their parents have to visit every day?

3) what can be done by our society to minimise the disturbance to our apartment.

Mr. Arvinda,

Your queries do not seem to have any relevance, except a sort of undue intervention in others matters.

Anyway, does the activity of the educational institute become a cause of any personal problem to you, if the school is opened or the land meant for access to the school is sold or not by the land owner?

If not so, in what way you are concerned with the problem of the school, land owner or the society?

Mr. Dhingra..Guess you have not understood the context. My query is regarding. Is school construction allowed with a 30ft access road in a residential layout. With 1000s of kids coming every day and adding to the their parents dropping/picking them, can a 30ft road handle the traffic. wanted to understand what does the law say.

Mr. Arvinda,

The context of your query is very clear to me. But I believe (not guess like you) that you have not understood my questions, if the school, or the unwillingness of the land owner to sell the land to the school is not expected to pose any personal problem to you. Also, if you have asked the query on behalf of your society, you must also have mentioned in what capacity you have asked the query on behalf of the society. Please don't mind, if I say, in the absence of your proper introduction, you can also not be expected to be the representative of 1000s of kids or their parents.

Even otherwise, your matter was quite of a commonsense as for knowing all that you could have approached the concerned local authority, the concerned municipal corporation, or the development authority or the traffic police authorities, whether they granted permission to open the school and on what basis, as the experts here cannot be expected to be the representatives of the local bodies or taffic police to clarify the issue on their behalf. Needless to point out, building byelaws differ from place to place, as per local requirements.

You cannot also expect the experts to know the topography of your place with road or the layout of the bylanes or footpaths along with 30 mt. road to guess what facilities or difficulties can be there.

SO, IF YOU ARE SHY IN REPLYING MY QUESTIONS AND ALSO MAKING MENTION OF YOUR PERSONAL CONCERN, YOUR ACADEMIC QUERY CANNOT DESERVE RESPONSE MERELY TO HELP YOU TO BECOME HURDLES IN EDUCATIONAL DEVELOPMENT OF THE AREA.
