My Grandfather owned properties in TamilNadu. He partitioned his properties to his four sons by way of “KOORCHIT” in 1947. I was given to understand that koorchit need not be registered and it is a legally valid document.

But recently in a land dispute , an enquiry officer ruled that koorchit being unregistered is not legally valid and saledeed of 1981 executed based on this koorchit is not valid.

Is it right? Kindly enlighten me .

Sale deed can only be declared invalid by the court and not by revenue officer,and such querry in 2009 is time barred.The revenue officer has not to go into such things and they have simply to enter the name of the purchaser as per the deed.

It is necessary to obtain the true and legal meaning of Koorchit before expecting any reply from the experts. I think it a Tamil word and not common in english so please get its english name so that I may understand its meaning and may submit my reply.

Kurchit is nothing but a form of partition deed, prevalent in Tamilnadu.

The kurchit or koorchit is valid and admissible to show that there was partition and is admissible as a document showing acknowledgment of prior partition. If subsequent transactions have taken place on the basis of kurchit, then the kurchit can be used as corroborative document in a court of law.

Why I am referring the admissibility is, the effect of non registration arises only only where you attempt to produce the kurchit to prove the partition.

Neither any authority or nor an enquiry officer has authority to rule or adjudicate in respect of title of a immovable property, except a civil court.

Ramesh sir,i will be much greatful if you provide me any reference such G.O., judgement, etc..for the legal validity of Koorchit.
