Sale flat

(Querist) 19 April 2013 This query is : Resolved 
I was planning to sale my flat. One broker brought a customer and we decided the deal. Customer given the token amount thru cheque and agreed to pay balance amount later. Broker taken written from me saying i have got token amount and balance will be paid later on plain blank paper with my sign. But token amount cheque got bounced and customer said to wait for 10 days for new cheque.
Now since i have not got token amount and paper is with customer, can i sell flat to another customer? Will this customer can make any legal issue? Kindly suggest.

where are you from ? it is difficult situation on you. you must appoint a lawyer immediately and tell to him aforesaid reason.

take in writing from the customer that he will pay in 10 days or else the sale wont tale place..or file petition u/s 138 NI..

It shall be better for you to immediately send a legal notice to the customer stating therein entire facts and wait for his further action till next 15 days of receipt of the legal notice and then you can issue a further notice stating therein the cancellation of the alleged deal as no money was paid by the buyer.

I will go by Mr. Makkads opinion. Do remember to return the token amount taken also as under all probability he may be reluctant to give anything in writing and may attempt to recover the same.

Mr. Matt! The cheque was issued against token money. The querist has no money to return as nothing was given to him except the mentioned cheque.

now i have got return the written paper from customer (Original), still is there any risk?
