salary not paid

(Querist) 18 April 2009 This query is : Resolved 
I was employed by a company registerd in Isle of Man and having corporate office in Dubai. Chairman of the company in which I was employed is also Chairman of one of the Indian company registered in India. I am not paid salary for six months and local living allowance for 5 months. I am holding outstanding certificate duly issued by the company management. Now let me know how to recover my dues.

If the company is also registered in India you file a case before the Labour Court for claiming your dues against the comapny where its registered office or work has been done. If the company has no existence in India then you may have to file the case wher the co. has registered.
There is no concerned with chairman. he may be the chairman of numbers of co.

According to ur question it is clear that co., is regd., in india, then first u issue a notice to the co., to pay the salary, if the co., kept quiet, then u file a case against the company in Labour Court.

Company is not registered in India. I think in such a case I have to file a case at the place of registration. Whether GOI can help. I have also lodged complain with MOEF, but no reply. Further, can I get help from the lawyers fraternity to file a case in UAE, where this company is having its corporate office. I can share the proceeds in agreed ratio. ramesh
