Respected Learned Advocates,

I was not able to arrange the stamp paper when i started stay. Can it be possible to have back dated stamp paper for this financial year. I buyed stamp paper on 20-10-2023. Can it be possible legally by some way to show the agreement for this fianncial year i.e. from 1.4.2023 to 30.3.2024. If yes then how ?

Purchasing of back-dated stamp paper is an offence and those who sold the stamp paper with a back date will also be punished as per Stamp Act rules. You have already purchased a stamp paper on 20.10.2023 so you can use it for the agreement.

The execution of the rental agreement vide a stamp paper subsequent to the date of commencement of the rental period is not an infirmity, you can proceed with the signing the papers accordingly but ensure the correct date of commencement of rent is mentioned in the rental agreement.

Rent Agreement can be executed even today for tenancy commenced from 01-04-2023 to 31-03-2024. No need to purchase back date stamp paper for this purpose.

Buy stamp paper today and attach it with actual agreement, which may commence your tenancy with effect from 01.04.2023 as desired.
Purchase / sale of back-dated stamp paper is an offence for which seller as well as purchaser can be prosecuted and punished.
