In transfer related case respondents-employer affirmed wrong information about the employee resulting in dismissal of O.A. in Tribunal in 2009. Information obtained under RTI,2005 revealed that respondent-employer had given wrong information. Sanction was sought for from the controlling officer to prosecute the concerned for willfully giving wrong information before the Tribunal.However controlling officer asserted that matter is under investigation but withheld further details. Pending completion of investigation, aggrieved employee has made misc.application before Tribunal for filing case of perjury under section 181 of I.P.C. in terms of section 195 of criminal procedure code. Kindly confirm if he has done right step. If not, kindly suggest step he has to take

if subseqnettly it was discovered that wrong information had been supplied you ought to have filed review application after discovery of new facts . the dismissal order of OA would have been set aside . why waste your time on perjury application?

Better try to get reliefs than filled with Vengeance.
