Regarding pay discrimnation

I am working in a school from 2007.School is private but runned by society in Delhi.Intially they were giving me a salary of 6000 rs per moth.But in 2008 school issued a refrence letter with different terms and conditions.One of the condition is that
To start with you shall be paid a salary of 5000 Rs Per month along with a admisible DA,besides usual allowances as per Central Govt Rules.This point was never implemented.This letter is Signed by PVC of School and Principal of the school at that time.I never got the salary as per Centeral Govt rules.Now I think I will fill a case in Court.In your opinion what what will be the result at the end .

You have not stated any concern of the private school with the Central Government Pay Scales. Has the management of the society adopted the Central scales for the scholl employees?

Actually it is Delhi Public School which is run by the DPS society New Delhi.It all follows the rules of Central Govt.Who ever talk to the management on the issue is kicked out by one way or another.Society is working under Cetral govt norms.Principal is getting salry as per Cetral govt,Admin officer is also getting salry as per central govt.rest othe employees are not getting the same.Plz reply

Are you giving acquittance for the same amount what you are receiving, or more than what is pad to you?

Also, what terms have been included in your appointment letter?

Terms & conditions of appointment letter

Some of the terms & conditions are

1. Intially you shall be on probation period of one year from the date of joining of school.
2.If your work and conduct during or at expiry of the period of probation is found satisfactory ,you shall on the period of expiry of probation or the extended period of probation as the case may be confirmed with effect from the date of expiry of said period.
3. You shall be retired at the age of 60 year.
4.You shall be the whole time employee of the institution.
4.You shall devote your whole time to the duties assigned to you from time to time by the principal.
5.Your appointment and continuation is further subject to the provisions of Delhi School Education Act 1973 and the rules framed there under.

7.To start with, you shall be paid a salry of Rs 5000 p/m along with admissible DA and other allowances as per Central Govt rules.
8.Free education to 2 children’s after confirmation.
9.Leave benefits as per Education Department Delhi Administration.
10.PF as per the EPF and Miscellaneous Provisions Act 1952.Employers contribution to PF will be paid based on the basic pay inclusive of dearness pay & dearness allowances and shall not be subject to the salary ceiling as mentioned in the aforesaid act/Provident Fund Scheme.
11. This appointment is subject to the approval of managing committee.

Lastly in case the above terms and conditions are acceptable to you then please return the duplicate copy of this offer of appointment after affixing your signature on the same in token of your acceptance and present yourself for duty.
Can I file the case before the court. On the basis of experience what will be the result.

Currently they r paying me 8600+500 PF only.

Before you ask any question here or decide to file a case in the court, it would be better for you to first get break up of Rs.8600+500 PF you are getting from the accounts branch of the DPS, as you have posted your question in a very delinked manner. I find you are not clear as to what relation Rs.8600 has with the basic pay of Rs.5000, as mentioned in your terms of appointment, and in which scale of pay you are getting Rs.8600.

You have also not mentioned in which scale of pay the other teachers of your category has been put by the school.

You have also not clarified one point whether you acknowledge the same amount you receive or you give receipt for more amount than you get.

Still further, it is not necessary that you would get the pay equal to others during your probation period.

So, at first get yourself clear on the isues of your appointment and salary structure.

First they give appointment letter conditions are written on it after that they r not giving salary according to the norms.They r giving the salary as per they wish.After the appointment letter was given salry was not given as per norms but consolidated salry was given at the rate of 6500 p/m in the next year year enhancement of 500 rs was given same procedure was later on followed.They r not giving any allowances.I will dispatch scanned copies of the documents on ur mail adress.
