Sir/Madam,
My case is pending in district consumer forum against a builder. I have submitted photos and threatening phone call recording in my evidence affidavit and the opposite party have submitted their evidence affidavit and in that they have submitted that all the photos that i have submitted are morphed and the phone call recording is also morphed. How to prove myself in this situation.

Your Advocate should file application for cross examination of persons who filed affidavit.

Consumer forum is allowing cross examination only in Medical cases and not allowing Cross examination in builder cases. Also I am fighting my case myself. There is no lawyer.

@ PS Dhingra Sir the issue is different in two queries. Here the issue is the opposite party is claiming my photos/phone conversation are morphed whereas the other query is related to the opposite party misguiding the forum with wrong photos filed by them.

If the issue is different in two queries, both the issues must also have backgrounds of the case, which you have avoided to post. In this case, if you have stated that the opposite party has alleged that all the photos that you have submitted are morphed and the phone call recording is also morphed, if you don't give description of your case and their arguments, how you expect anyone to suggest you how to prove yourself in this situation.
The simple answer is discuss the issue with your lawyer how to prove yourself in this situation, as it is only he who knows the background of your case. If you don't have any lawyer, better hire some capable lawyer to fight your case or else only you have to prove how the photographs and recording is not morphed.
The question arises, how the experts would know that the photographs and the recording is not morphed.
For vgue queries, you should not have expected tutorials from experts without discussing appropriate background of the case.

Sir,
The case is against a builder who is supposed to handover the possession in last year june 2014. But till date the works were going on and occupation certificate from the concerned municipality was issued in March 2015. In May 2015 the opposite party have filed their evidence affidavit and filed the photos of the building stating that the building is ready for occupation since June 2014, as now the building is almost complete. The case was filed way back in Aug 2014. And also in their evidence affidavit they are claiming that whatever photos that I have submitted are morphed and not correct.

Ever since your joining this forum for less than three weeks, you have raised academic queries, at first in the name of Mr. Prasad and later in the name of Venkata Krish. Any reason for change of your profile name and asking for merely academic queries only?
However, in the case of present query, when you have some proof, why can't you refute the claim of the opposite party? If you are unable to prove yourself, hire some capable lawyer to help you prove your cas.

Is there any rule that we are not supposed to ask the queries related to District consumer forum. I am not aware of any such rule. However thanks for your advise. You can ignore my queries if I am bothering you. I have been getting replies from other lawyers for the queries I have posted. Once again sorry if my queries are bothering you.
