Regarding court fees

Hi Friends.. I am M A Bijapur Adv from Gadag(Kant). i have a query please answer supporting citation.
The question is: In a suit for partition by a son challenging the alienation by way sale made by father, whether court fee is payable on sale deed Or as normally paid under sec 35?

Court fee on sale-deed is liable to be affixed in the given case as the sale deed is required to be set aside in the given case.
