First allottee of tnhb flat sold the flat mentioning 1/3 share of uds of land extent of plinth area of flat since uds not mentioned in the original sale deed. The second purchaser got correct uds from tnhb thro deed of rectification in his favour. Whether the original allottee has any share in the uds assigned to the second purchaser.
This discussion addresses a complex property query regarding the Un-divided Share (UDS) of land for a TNHB flat. The original allottee sold the flat without the UDS being explicitly mentioned in the sale deed. A subsequent rectification deed granted the correct UDS to the second purchaser. The core question is whether the original allottee still holds any claim to this UDS assigned to the new owner.
