Reg. procedure adopted by the probate court in delhi

Sir,

I submit that I want to file a probate petition in the probate court in delhi. Therefore, I want to know about the step-wise detailed procedure being adopted in the probate case in delhi and how much time will to take to grant me probate.

Dear Querist,

As regards filing of a probate petition in Delhi, you need to file the same in prescribed format along requisite affidavits. The original deed of WILL is also need to be annexed. If witnesses/other legal heirs are supporting your petition, ask them to give NOC as well affidavits to that effect.

It takes almost 6 months to 1 year if not contested by interested parties.

It requires to be filed in the concerned civil court wherein all legal heirs of the deceased are required to be impleaded and due notice is required to be given to them and after hearing them and obtaining evidence from both sides, the court shall decide the matter. A prescribed fe of 3% is imposed over the value of the property.
