Refund of court fees:

(Querist) 09 September 2008 This query is : Resolved 
if the Plaintiff lost the case after depositing huge amount of court fees and does not want to pursued his case further, can he get back the fees deposited in the court by way of Court fees? What is the procedure? Can the court refused to refund?

If the matter is settled before the LOK ADALATH the court fee paid by the plaintiff can be returned.

as Sanjay Sir said only in the matters settled before the LOK ADALAT the court fee can be returned to the plaintiff and also when the Plaint is rejected by the court before which it is filed.

I agree with Sanjay Sir that if the matter is settled in Lok Adalat, Full Court fee may be refunded to the plaintiff.

As per the procedure, if the plaintiff withdraws the case before the stage of trial, Half of the Court fee may be refunded.
