Refund of court fee on out of courr settlement

What are the provisions and procedure for refund of court fee when both the parties go for out of court settlement? How much court fee shall be refundable.

If the settlement has completed then file an application or orally submission before court for mediation and after settlement before mediation you can file an application for return court fee.

You must have Engaged Advocate for court case. Don't you trust him, that he knows the procedure and do the needful???????

court fees is refundable, if no court proceeding. If part heard, refund will be in part.

Upon a memo informing the court that the matter has been settled out of court hence the suit may dismissed as not pressed, the court will dismiss the suit, after which, as per the Tamilnadu Court Fee Act, 50% of the court fee is refundable on an application for refund by the counsel for plaintiff. However, if the matter has been referred to Lok Adalat and the mutual compromise has been recorded before the Lok Adalat, refund of full court fee paid is eligible. This may differ from one state to another, hence check it up locally.
