when builder follow the completion method for each project on consistency basis , and project is completed only O.c. is under process to release to builder , and mostly 85% flats are sold, one of the flat is sold on the basis of the letter of allotment but agreement for sale and stamp duty is yet to paid , can receipt of advance to be considered as sale ? under which basis so ?

Receipt of advance can not be considered as sale.
But since many builders are cheating there are various ruling /judgement which certainly help flat buyer and his interest are secured and he can complete formalities transferring blame on builder/investor of project .
Flat buyer should take professional help in this regards , don't keep matter pending
