Querry on bounced cheque hypothicating aircondnr against it

we had rentd out a flat to an individual w/o proper verification. He paid deposit by chq. In d midst he needed money so he hypothicated his new a/c to us and tuk money for some urgnt hosp. He kept d challn n few documnts as a pruf of ownrship

Later v found that he had bouncd d chq n was unable to return money too. He vacated d flat w/o even informing.
We made a complnt in police stn of bounced chq and claim for refund.

what is our right on d a/c. Can i install dis a/c as no action taken by police on it

you can initiate criminal proceedings against him u/s 138 of NI Act. Contact your lawyer.

First Serve him legal notice by Advocate for demanding due money towards him within 15 days from the receipt of notice by him. If he fails then he is liable to face criminal proceedings u/s 138 of NI Act.

No other option than serving legal notice and proceed under NI Act.

first of all issue him a legal notice if u have his latest address. if he does not respond, then file a criminal suit under NI act sec 138.
