After death of father, an undivided property, whether can be sold by mother where son is present, without signature of the son?
Supposing, Died person is Hindu and leave behind wife and son. So, both have equal share. wife can't sell legally property unless son have to execute relinquish deed in her favour.

Mother can sell her share of the property even in nature of undivided property.

a loan taken from the said property by son. loan a/c become npa. son taken the loan. mother is guarantor. now, mother want to sell the property and close the loan, but son do not agree. it is a hindu family.

Widow of deceased can sale only her own 1/2 share without the consent of her son.
