Proof of return of Istridhan

Querist : Anonymous (Querist) 11 November 2010 This query is : Resolved
Girl side filed FIR under section 498A. iN UP. And in mediation both husband and wife decided to live together with some illogical conditions.

As per demand of wife we have returned the pending Istridhan to them and taken acknowledgment from them.
Now they want acknowledgment back so that they can submitt it to mediation center in allahabad for quashing of FIR
Pls advise how can i give this to them.
Should i keep one copy attestedby notary or any other method.

It is safer to retain the ack with you. You can make an attested copy of the same and hand over such a copy to them.

well keep the original with you, you may give them the photocopy of the same.

since you are accused in the FIR therefore the quashing petition has to be from your side, and it will be in your interest if you get the acknowledgment to the court in your petition.

for all obvious reasons quashing will not be done without the petition by the accused.

When Girl side filed 498a in UP in july'10; We filed petition in HC Allahabad for quashing of FIR and We got Stay Arrest and Case was sent to mediation center.
Reconcilation was done in Mediation center with some conditons. and to return of baalnc eistridhab is obe of this.
Now Girl side lawyer is asking for original ack. to be present in HC for quashing of FIR.
Is it ok or they have bad intentions behind this.

Need not necessary to give original acknowledgement to the other side counsel. You are advised to file a petition before High Court for quashing FIR.
