Kindly suggest that who is the responsible for PF transfer or PF withdrawal (organization or employee). if a employee leave his service ,how many days required for withdrawal PF.
and also clear that what is the period for settlement of an employee who resign from his service .
and what is the legal procedure .

The regional provident commissioner office is the authority for settlement. With the help of prescribed forms the employee file the settlement claim or transfer form signed by the employer is eligible. Form 19 and 10c for withdrawal and Form 13 for transfer of pf amount from existing to new employer account

PF department is the settlement office, submit all the forms duly completed and they would settle the claim.

You have initiated a good discussion.
The employer usually authorizes HR personnel for this activity.
The concerned HR personnel should preferably educate the exiting employee on the subject and help him by providing the respective forms and urge to submit the same.
The concerned HR personnel can provide the attested copies of PF forms to employee on the day of separation.
The employee can submit the forms to employer any time.
The concerned HR personnel (sensible ones) should attest the forms and submit to concerned PF office within 5 days and supply the acknowledgment issued by PF office (for employee) to employee by effective mode of communication preferably by redg. post.
Declinature to attest the forms is offence hence concerned HR personnel should not indulge in any activity even if bosses signal for it. It shall not be out of place to mention that NO SENSIBLE BOSS shall issue such instructions in writing i.e. to withhold or delay. It shall be pertinent to mention NO
SENSIBLE HR PERSONNEL shall abide by such unfair, bad instructions. There are threads at LCI also initiated by HR personnel indicating that penultimate actions have been initiated against them by employees/Dept. authorities/ Lawful authorities/even employer and they become a scapegoat.
The FNF statement should be supplied to employee for verification and acceptance and FNF wages should be paid on last day in office. The unpaid wages is debt on employer.
The wages have to be paid on specified day for payment of wages and employee can lodge complaint the moment his wages are delayed even by a day.
The internal policies of the company should be in line with enactments applicable to the company and internal/private policies of the company are not and can not be law unto themselves.
In case of dispute the employer shall have the concerned HR personnel to blame hence concerned HR personnel should watch his steps and perform the activities carefully and in time.
The sensible HR personnel shall always inculcicate good HR practices in the company and make themselves and employer most sought after names and companies in the trade and market.
