Hi, I stay with my mother in a pagdi house as a tenant past 29 years. The papers and rent receipts are in name of my mothers sister.We are paying the rent till date and hold possesion and residence proofs like SBI passbook 25 years old, ration card(my and mom name), passport, DL on same address. They never resided here nor have any address proof. Light bill is on previous owners name. 29 yrs back mother's sister asked to sell the property (through a letter) due to her financial crisis for which she was sent the money in form of a DD. We thought that why to worry when its on a family members name and hence didn't transfer it on our name. Now they are demanding the house. We stay in other flat now but don't want to give it to her as she does not have a moral right in that property as she has already taken money. All documents for above mentioned are available with us. plz suggest.

rent receipts must be in name of your aunt. your aunt is tenant not your mother but fact that your mother has been staying in house for many years would make it difficult for your aunt to vacate your mother from said house

Peaceful possession of over 22 years would entitle you to lay claim on the said property.
