my residential property is parental property in delhi from the time of pre pre grand father and we are four real brothers. One brother want to relaese our share to 2nd younger brother. both are agreed want to register the relese deed with registrar at delhi. Our fatherwas expired in 1989 & mother was expiredin 2004. for registration of relese deed , we require ownership proof for submitting with registrar but we have no any document except yearly house tax receipt and one copy of letter issued by MCD in march 1994 after death of my father regarding mutation/ sub division said property in favour of all four brothers. ownership of document is not necessary just property extract is sufficient to execute the regd., rights relinquish deed.
IN my opinion it is better to file suit for partition,when there is no document to show that property is in the name of 4 brothers.
file a suit for partition on one of the brothers or on three brothers stating that defendants i.e., brothers are denying the share so this suit is filed and then get it compromised and on the basis of compromise decree file an application to get enter your names, in the said compromise petition any one can relinquish their rights to other person. sir,
on the present status ,share of property on equal base i.e.25% of each brother. Can one brother release our 25% share to another brother as 25% share of undivided property thorugh registered release deed with considering any money?
