What is section 9 in Metrimonial law? Is it helps in against the misuse of 498A (Dowery Law)and prevent the innocent family members of the boy?Few months back my brother's in-laws beat my brother and took his wife to there home , and next day of the incidence they came to my home and insult my family on road of my society, it seems that they r not in mood of resolving the issue calmly. from then my brother's wife reside in their parents's house.My brother had a daughter of 5 yrs, she is with my brother.Now my brother do not want his wife to come back as he can't do faith on her. It might be possible that the girl can trap our family by doing some drama if he agrees to take her back.Now his father threat my family to make her back or he will take a legal action against my family...
Pls tell me what are the steps should we take for being at safe side. May be they will plan to launch a complain under 498A. Pls tell me what r the precautions should my family have to take for protect ourself...Pls help me its urgent...

Section 9 of the HMA is a suit for restitution of conjugal rights and it is not a defence of 498A case.
Since you are the vulnerable now to get implicated in the 498A case, you have to keep track of the lodging of FIR. once that is lodged you have to immediately file a case for anticipatory bail. You could also in the meantime make a GD in the local police station stating the above facts.

well u should disinhertiate ur brother and his wife by publication in some daily news paper and ur brother should file divorce case in court moreover as my friend has told make a General Dairy Report in local police station and also file defamation suit against oppsite person and keep track of their efforts and if any compliant is moved then file anticipatory bail
