Need for "letter of administration" for khata transfer

Hello all,

I have a BBMP property at Bangalore which was jointly held by me and my unmarried brother. He has died 2 years back.

Now I want to sell that property. I was told that that my brother's share of the property will go to my mother as my father is not alive.

Now to do the khata transfer to my mother's name I was told Letter of Administration is required. But in the list of documents needed for khata transfer mentioned by BDA they have not specified the need for Letter of Administration.

Can experts please tell me if Letter of Administration is essential for khata transfer or not. Does khata transfer to my mother's name enable me to sell the property. If not, what do I need to do, Kindly let me know.

1. The fact that you and your late brother were co-owners of such property and hence to have his share devolved upon his mother and for that the mother has to obtain such letter of administration and then later she can have her name mutated in the record of rights of such property along with your name. Then after that both of you can sell the property.

On the BBMP web-site they don't mention the need for Letter of Administration. They just mention about the affidavits and NOC from the other surviving members. They don't even know what is letter of administration. When I told them, they don't need it and if I give they will take it.
