HI
MY SELF DEV,RESIDING IN INDIA, I AM A PAKISTANI CITIZEN, AND LIVING HERE ON LTV BASIS FOR THE INDIAN CITIZEN PURPOSE, I AM MARRIED TO AN INDIAN WOMAN. MY FATHER IN LAW WANT TO GIFT A FLAT,BUT HE WANT TO GIVE IN NAME OF BOTH OF US, NOR SEPARATELY TO MY WIFE, AND NOR TO MY SELF,
I WANT TO KNOW THAT,AS A PAKISTANI CITIZEN, I HAVE THE RIGHT TO BE THE PART OF MY IN LAWS PROPERTY,AS HE WANT TO DO.
PLZ HELP ME, I NEED HELP,
MAY INDIAN LAW ALLOW ME TO BE THE PART OF PROPERTY ALONG MY WIFE..

AS IN GUJARAT MANY PAKISTANIS LIVES HERE, THEY ARE BRINGING MONEY TO THIS COUNTRY TO SUPPORT THEIR FAMILY & OFF COURSE IT IS POSITIVE FOR OUR COUNTRY'S GROWTH TOO, THEY ARE BRINGING MONEY NOT SENDING IT.
SO Y THIS KIND OF LAW IS..
WE WANT TO BE INDIAN.Y WE HAVE NO RIGHT FOR THESE THINGS.

Dear dev,

As its known that ownership of property by foreign nationals is subject to scrutiny from the governments. In india for eg in himachal pradesh state even indian nationals not originally residents of the state cannot own property in their name. As land and property are state subject to local laws will govern. You have not specified the state where the property is located making it difficult for me commment further.

Another aspect is that after terror attacks in india the ministry of external affairs has started keeping a close eye in property transactions in the country involving foreign nationals. Many'er times approvals will be required to be taken from them. Actually as land laws and registration of the same are made by the state government all these aspects will have to be measured from the place where the property is located.

A foreign National cannot retain property in his personal name in India rather NRI can do it. So you require Indian citizenship first and then fulfil the desire of your father in law.
