Name transfer declaration

Querist : Anonymous (Querist) 18 December 2023 This query is : Resolved
Respected Experts,

I purchased a new car from the showroom, and in exchange, I provided my old car to the showroom. Subsequently, the showroom sold the car to a third party, and currently, neither I nor the showroom can establish contact with this third person for the purpose of transferring the name on the RC Book at the RTO office.

Dear experts, I seek your advice on whether I can file a civil suit for a declaration in court. I sold the car to the showroom, and I wish to clarify that my liabilities should end in the event of any wrongful activities carried out using that car.
T. Kalaiselvan, Advocate Online (Expert) 18 December 2023
While the showroom arranged for exchange formalities, they would have provided you with the documents for completing the exchange and sale of your old car to the buyer, hence the documentary evidences in this regard would be sufficient for yo to writ to the concerned RTO about the sale of old car to so and so person on so and so date, after which you can give a newspaper publication stating that the car number so and so was sold to xyz, whereas he has not transferred the same to his name so far hence any accident or incident that may take in between will not implicate you in any manner neither you are liable for any such incident.
This will protect your interests.
