My Neighbourer constructed wall in front of my house door

(Querist) 19 December 2010 This query is : Resolved 
The land in front of my house is government land, but my neighborer has illegally occupied it and also partially covered it constructing a wall. This wall is in front of my house door which is very inconvenient for us. In this regard a case was filed by my father 4 years ago in a local court but result is....date on date ...date on date ...How can we get quick judgement on this issue from the court?...kindly suggest.

If some body had encroached the govt land, file a writ in HC for speedy remedy.

Movve the hih court under Article 227 of the consttution to expedite the case in the lower court.

Issue notice u/s80 of CPC to the muncipality to remove the wall which has constructed on the govt., land. if muncipality failed then file a suit for mandatory injunction against the the neighbour and muncipality. If matter is ujrgent file an application u/s 80(2) of CPC to dispense the notice along with the suit.

If you has made Govt body as party then the Hon'ble Court will directions to the body for its removal
Speedier trail is to move the writ petition

You can file a Writ Petition before the High Court for speedy remedy and may also pray for speedy disposal of the case before the Trial Court if High Court does not grant any relief.
