Marriage and divorce

Querist : Anonymous (Querist) 19 August 2010 This query is : Resolved 
A girl (x) is married to man (b) who is christian. They have a girl child out of the wedlock. Due to conflic between x & b, x begins having an affair with (h). X is driven out of house by B. H has physical intercourse with x and over time, X and H marries without divorce to B and without knowledge of B. X and H has a child. In the meantime, H is no more interested in X and leaves her. X stays with her mother and son. X files a 498A aginst H and also a DV against H for maintenance from him for herself and her son. I want to know can X claim maintenance from H when they were not married or will the son be entitled for compensation from his father H. Pl. reply urgently on this peculiar case before me

Under S. 125 CrPC son from H is entitled for maint.

Under DV Act, 2005 son from H is also entitled for maint.
