My father met with an accident in 1990, fractured his fight thigh, operated upon and rod inserted in his thigh. He filed a case for Rs.10 lakh compensation under MACT but the Session Judge ordered only 12500/- (which was half of the minimum Rs.25000/- that time)with 9 pc interest by the Insurance Company in Feb 2002. We filed FAO in High Court but due to Lawyer's bribing, he didnt turn up for hearing and the case disposed off after 2-3 years.
We didnt do anything after that.
Can the award by the lower court be executed after a gap of 10 years now.
Can we appeal again with any good lawyer.
My father is now retired from Govt. service and 70 years of age.

I have some civil suit pending before HC and lower court in same type business matter filed on false basis. Hon'ble Judge is giving date of 3-4 months. Due to that my project is delaying and motive of plaintiff is solving.
Is there any process for speed trial?

Shonee Sir, I' am of the view that award passed by the MACT is on equal footing of a judgment of the Civil Court within the meaning of the Civil Procedure Code, as such, execution of the decree Or award would be 12 years.

Which court you can put petition for early hearing to hear and dispose the matter with sufficient reasons.
